Practice Focus

After 10 years as chair of the Intellectual Property and Technology Group, Doug stepped down from that position in 2010 to focus on his dynamic and challenging IP practice, his tenure culminating in a New Hampshire Business Review “Best of Business” Award for the firm’s IP practice. While Doug practices in most areas of intellectual property, he concentrates his efforts on trademark, copyright and licensing work. Doug handles all aspects of trademark prosecution, from initial trademark selection, screening, coordinating with marketing personnel, and opinions, to prosecution and maintenance of trademark registrations, and dispute resolution. He advises clients on various aspects of copyright protection as well, including license agreements, registrations, disputes, endorsement agreements and agreements with publishers. In the licensing area, Doug drafts and reviews agreements, including software development and license agreements, SaaS (ASP) agreements, trademark and copyright license agreements, and other IP agreements, and advises clients on various aspects of the licensing process. He has negotiated and been involved in the drafting of system wide license agreements for medical, educational, and nonprofit service-based organizations. He also has undertaken work in the area of minimum advertised price policies and related antitrust issues. Having handled complex intellectual property, commercial, and corporate litigation, his litigation background enables him to bring those insights and skills to the administrative litigation aspects of trademark prosecution. His clients represent diverse business interests, including manufacturing, technology, education, and the arts. He works closely with foreign counsel in numerous countries on both trademark and licensing matters.

Sample Matters

  • Drafted substantial copyright materials, including a copyright handbook, copyright policies, TEACH ACT Guide and FAQ for a university.
