Sheehan Phinney Attorney Michael Lambert Prevails In Action For The Town Of Milford |
(October 24, 2006. Manchester, NH.) - Sheehan Phinney Bass and Green shareholder Michael J. Lambert assisted the town of Milford in an action against a company hired to conduct a town-wide property assessment. The case, Town of Milford v. Cole Layer Trumbull Company, involved claims of breach of contract, negligence and violation of the New Hampshire Consumer Protection Act.
The contract in question required CLT to conduct an appraisal and revaluation of town property for tax year 2000 that complied with the Department of Revenue rules and met with the satisfaction of the New Hampshire Board of Tax and Land Appeals. After CLT completed the reassessment, the board ultimately found that CLT had not satisfactorily performed the reassessment, forcing the town to hire another company to conduct a second town-wide assessment.
Milford sued CLT and the issue was referred to a private arbitrator pursuant to the parties' original contract. At arbitration, Lambert established that CLT breached the contract by prevailing on a partial motion for summary judgement. The parties had a multi-day hearing on damages that resulted in a six-figure award for the town. In addition, Lambert convinced the arbitrator that CLT had violated the Consumer Protection Act and secured a significant award of attorneys' fees and costs for the town.
