(April 12, 2006. Manchester, NH.) - Sheehan, Phinney, Bass + Green attorney Rob Miller has won approval for James T. Rymes to construct 22 state-of-the-art airplane hangars at the Hawthorne-Feather Airport, prevailing after a strongly-contested case against the Town of Deering.
The New Hampshire Department of Transportation issued its approval for the project on April 10, 2005, which will allow construction on the hangars to begin later this spring.
After initial efforts to obtain approvals from the Town of Deering Planning and Zoning Boards failed, Miller successfully argued that various provisions of state law in the New Hampshire Aeronautics Act controlled local review of the airport hangar project.
Given the rapidly increasing conflicts between pro-growth and anti-growth interests in cities and towns around New Hampshire, this case has been closely watched across the state. A hearing on this case at the Department of Transportation last year drew nearly 100 interested observers. The case also represents a substantial victory for Rymes, private pilots, and the Hawthorne-Feather Airport, as it will permit the modernization and revitalization of this important regional resource.
