McGrath Successfully Defends National Corporate Client Following Hearing At NH Department Of Labor |
(October 25, 2006. Manchester, NH.) - David W. McGrath,a shareholder at Sheehan Phinney Bass + Green, successfully defended a national corporate client following a hearing at the New Hampshire Department of Labor, which involved a several hundred thousand dollar wage claim.
This case involved a claim by a former salesman, who argued that that he was entitled to several hundred thousand dollars from his former company. Among other things, he claimed entitlement to commissions on sales revenue the company received after he departed on accounts he initially brought to the company or serviced, but whose insurance contracts were renewed by other salespersons after he departed. After an evidentiary hearing, the Department of Labor ruled in favor of the employer.
The case involved interesting legal issues concerning recent New Hampshire Supreme Court decisions on wages and commissions as well as issues concerning the employee's negotiated employment contract.
