(March 11, 2005. Manchester, NH.) - Bill Donovan, president and managing director of Sheehan Phinney Bass + Green PA successfully represented Great Bridge Properties, LLC in an unlawful discrimination suit against the Town of Ossipee, New Hampshire.
Donovan was retained by William Caselden and Christopher Davies, principals of Great Bridge Properties, LLC, in an action suit against the Town of Ossipee Zoning Board of Adjustment filed in 2003. The lawsuit sought to invalidate provisions of the Ossipee Zoning Ordinance on the grounds that they unreasonably restricted any new low-income, multi-family housing from being built in the town. On January 21, 2005, Judge Mohl of the Strafford County Superior Court found that the applicable provisions of the Ossipee Zoning Ordinance were illegally discriminatory against low-income housing residents. The decision made in favor of Great Bridge Properties allows a proposed housing project to move forward pending site plan approval from the Ossipee Planning Board. The court also ordered that the Planning Board process be expedited.
